1. ACCEPTANCE OF TERMS

By accessing, browsing, or purchasing from EthanMakesArt ("we," "us," or "our"), you ("Customer," "you," or "your") agree to be fully bound by these Terms of Service ("Terms"), our Privacy Policy, and our Shipping Policy, all of which are incorporated herein by reference. If you do not agree with any part of these Terms, you must not use this website or place any order. Your continued use of the site following any posted updates constitutes acceptance of those changes.

2. ELIGIBILITY

By placing an order, you represent and warrant that: (a) you are at least 18 years of age or the age of majority in your jurisdiction; (b) you have the legal capacity to enter into a binding contract under applicable U.S. law; (c) all information you provide is accurate, complete, and current; and (d) your use of this site does not violate any applicable law or regulation.

3. PRODUCTS AND PRODUCT DESCRIPTIONS

EthanMakesArt sells resin religious lamps, including Jesus-themed and other devotional resin lamp products.

Manufacturing Transition Notice — Mandatory Disclosure:
Due to high demand, products that were previously crafted by hand (handmade) have transitioned to production in industrial manufacturing facilities. By communicating this transition within these Terms of Service, EthanMakesArt bears no responsibility for any claims based on expectations of handmade or artisanal craftsmanship. By completing a purchase, the Customer expressly acknowledges and accepts this condition. No claim, chargeback, or dispute based on the expectation of handmade manufacture will be honored after the date of purchase.

We reserve the right to modify, discontinue, or substitute products at any time without prior notice. Product images are for illustrative purposes only. Minor variations in color, finish, texture, or dimensions between the displayed image and the delivered product do not constitute a defect, misrepresentation, or grounds for a return, refund, or dispute.

We do not guarantee that product descriptions are error-free. In the event of a pricing error or product description error, we reserve the right to cancel any order placed at an incorrect price, notifying you by email at the address you provided.

4. ORDERS AND CONTRACT FORMATION

Placing an order constitutes an offer to purchase subject to these Terms. A binding contract is not formed until we send you an order confirmation email. We reserve the right to refuse or cancel any order at our sole discretion, including for reasons related to product availability, errors in pricing or product description, or suspected fraudulent activity.

By submitting an order, you authorize us to charge your selected payment method for the full order amount, including any applicable taxes and fees.

5. PRICING AND PAYMENT

All prices are listed in U.S. dollars. We accept payment methods as displayed at checkout. You represent that you are authorized to use the payment method provided. EthanMakesArt is not responsible for additional fees charged by your bank, card issuer, or payment processor.

We reserve the right to modify prices at any time. Price changes will not affect orders already confirmed. Applicable sales tax, if any, will be calculated and displayed at checkout in accordance with the laws of the applicable jurisdiction.

6. SHIPPING AND DELIVERY

Processing Time: Orders are processed within 1 to 3 business days from the date of purchase. Business days are Monday through Friday, excluding U.S. federal holidays.

Estimated Delivery Time: After processing, estimated shipping transit time is 13 to 20 business days. This is an estimate only and not a guaranteed delivery date.

Delays: Delivery timelines may be affected by carrier delays, customs processing, weather events, international logistics disruptions, peak season volume, force majeure events, or other circumstances beyond our control. Such delays do not entitle the Customer to a refund, cancellation, order modification, or any other remedy. By placing an order, you acknowledge and accept that delivery timelines are estimates and that logistical delays beyond our reasonable control do not constitute a breach of contract or grounds for a refund or dispute.

Shipping Address: The Customer is solely responsible for providing an accurate and complete shipping address at checkout. EthanMakesArt is not liable for undelivered orders resulting from an incorrect or incomplete address provided by the Customer.

Risk of Loss: Title and risk of loss pass to the Customer upon handoff of the shipment to the carrier. EthanMakesArt is not responsible for lost, stolen, or damaged packages after carrier pickup. Any claims for lost or damaged shipments must be initiated by the Customer directly with the carrier.

7. CANCELLATIONS

Orders may be cancelled only before they have been submitted to fulfillment processing. Once an order has been sent to processing or shipped, it cannot be cancelled under any circumstances. No exceptions will be made. If you wish to request a cancellation, you must contact us immediately at ethanhandmades@gmail.com. Cancellation is not guaranteed and is subject to our confirmation.

8. RETURN AND REFUND POLICY

We offer a 90-day limited return window, subject to all of the following conditions, which are strictly enforced:

8.1 Eligibility Requirements
To be eligible for a return, the following conditions must all be met without exception:

  • The return request must be submitted within 90 calendar days from the date of delivery as recorded by the carrier's tracking system.

  • The product must be completely unopened.

  • All original factory seals, shrink wrap, and packaging seals must be fully intact and undamaged.

  • The product must be in its original, unaltered condition with no signs of use, installation, manipulation, assembly, or tampering of any kind.

  • The original packaging, all accessories, inserts, and documentation included with the product must be returned in their original condition.

8.2 Non-Eligible Items and Exclusions
The following are expressly excluded from return eligibility and no refund or exchange will be issued:

  • Any item that has been opened, regardless of whether it was used.

  • Any item whose factory seal, shrink wrap, or packaging seal has been broken or removed.

  • Any item showing any signs of use, installation, assembly, display, or handling beyond initial inspection of the sealed exterior.

  • Any item returned without its original packaging or with damaged, defaced, or missing original packaging.

  • Any item returned after the 90-day window from confirmed delivery date.

  • Any item returned without prior written authorization from EthanMakesArt.

  • Claims based on minor variations in color, finish, texture, or appearance compared to product images.

  • Claims based on expectations of handmade or artisanal craftsmanship, as disclosed in Section 3 of these Terms.

  • Orders not delivered due to an incorrect shipping address provided by the Customer.

8.3 Return Shipping Costs
All return shipping costs, including but not limited to postage, packaging materials, insurance, and any associated carrier fees, are solely the Customer's responsibility. EthanMakesArt will not provide prepaid return labels or reimburse return shipping expenses under any circumstances.

8.4 Original Shipping Costs
Under no circumstances will original outbound shipping costs be refunded, regardless of the reason for the return.

8.5 Return Authorization
Before shipping any return, you must contact us at ethanhandmades@gmail.com to obtain written return authorization. Returns sent without prior written authorization will be refused and returned to sender at the Customer's expense. Authorization to return an item does not guarantee approval of a refund.

8.6 Inspection and Refund Processing
Upon receipt of a returned item, EthanMakesArt will conduct a complete inspection of the product and its packaging. Refunds are issued only after this inspection is fully completed and the item is confirmed to meet all eligibility requirements set forth in Section 8.1. We reserve the maximum processing period permitted under applicable law to complete this inspection and issue any approved refund. Refunds, if approved, will be issued to the original payment method only. EthanMakesArt reserves the right to refuse a refund if the returned item does not meet all eligibility requirements upon inspection.

8.7 Logistical Delays
Shipping delays, extended transit times, or delivery outside estimated timeframes do not constitute a defect, failure of delivery, or breach of contract, and do not entitle the Customer to a refund, cancellation, or any other remedy.

9. CHARGEBACKS AND PAYMENT DISPUTES

By completing a purchase, you agree to contact EthanMakesArt at ethanhandmades@gmail.com and follow the return and refund process described in Section 8 before initiating any chargeback or payment dispute with your bank or card issuer. Initiating a chargeback without first following this process, or initiating a chargeback for reasons that are inconsistent with these Terms, may be considered fraudulent misrepresentation. We reserve the right to dispute any chargeback and to provide the relevant financial institution with documentation of these Terms, your purchase confirmation, and any applicable shipping records.

10. 90-DAY LIMITED WARRANTY

EthanMakesArt provides a 90-day limited warranty covering manufacturing defects present at the time of delivery. This warranty does not cover damage resulting from misuse, improper installation, accidents, alterations, normal wear and tear, or any cause not attributable to a manufacturing defect. This warranty is the sole and exclusive warranty provided by EthanMakesArt. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. To make a warranty claim, you must contact ethanhandmades@gmail.com within the 90-day period from the confirmed delivery date and provide photographic evidence of the alleged defect.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ETHANMAKESART, ITS OWNERS, OPERATORS, AFFILIATES, AGENTS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THIS SITE, YOUR PURCHASE, OR ANY PRODUCT SOLD HEREUNDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL ETHANMAKESART'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

12. DISCLAIMER OF WARRANTIES

THE PRODUCTS AND THIS SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. ETHANMAKESART MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, EXCEPT AS EXPRESSLY SET FORTH IN SECTION 10. YOUR USE OF THIS SITE AND PURCHASE OF ANY PRODUCT IS AT YOUR SOLE RISK.

13. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the United States and applicable state law, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or any purchase made through EthanMakesArt shall first be subject to good-faith negotiation initiated by written notice to ethanhandmades@gmail.com. If not resolved within 30 days, disputes shall be resolved by binding individual arbitration under the rules of the American Arbitration Association then in effect, and not by class action. You waive any right to participate in a class action lawsuit or class-wide arbitration. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

14. INTELLECTUAL PROPERTY

All content on this site, including but not limited to text, images, logos, graphics, and product descriptions, is the property of EthanMakesArt or its licensors and is protected by applicable U.S. intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this site without prior written permission from EthanMakesArt.

15. PROHIBITED CONDUCT

You agree not to: (a) use this site for any unlawful purpose; (b) submit false or fraudulent orders or information; (c) interfere with the operation of this site; (d) attempt to gain unauthorized access to any portion of this site; or (e) use this site to transmit any harmful, offensive, or disruptive content.

16. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless EthanMakesArt and its owners, operators, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your use of this site, or your violation of any applicable law.

17. SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

18. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and Shipping Policy, constitute the entire agreement between you and EthanMakesArt with respect to your use of this site and any purchase made hereunder, and supersede all prior or contemporaneous communications and proposals, whether oral or written.

19. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of this site or placement of an order after the posting of any changes constitutes your acceptance of the revised Terms.
